Acceptance

By downloading, accessing, or using Fax Prime: Send & Receive, you agree to these Terms. If you do not agree, do not use the app or related services.

You must be able to form a binding agreement and you must use the app only in locations where its use is lawful.

The service

The app helps users prepare, send, receive, store, and manage fax communications. Fax delivery depends on telecommunications networks, recipient devices, third-party providers, document quality, recipient availability, and other factors outside our full control.

Status messages, confirmations, transmission reports, timestamps, and app history are provided for convenience and service operation. They are not a legal opinion, certified proof of notice, or a guarantee that a recipient read, accepted, or acted on a fax.

Your responsibilities

• You are responsible for the documents, numbers, recipients, cover pages, and messages you submit.
• You must have the legal right to send each fax and to use each recipient number.
• You must verify recipient numbers and document contents before sending.
• You must keep your device, Apple ID, account access, and app data secure.
• You must keep copies of important documents outside the app if you need long-term records.

Prohibited use

You may not use the app to:

• send spam, unsolicited advertisements, junk faxes, harassment, threats, phishing, fraud, or deceptive content;
• send marketing or promotional faxes without all required consent, business relationship, sender identification, and opt-out notices;
• ignore or evade opt-out, do-not-contact, revocation, or recipient stop requests;
• harvest numbers, test numbers in bulk, or use the app as a dialing or fax-number discovery tool;
• send unlawful, infringing, defamatory, abusive, obscene, discriminatory, or harmful content;
• impersonate another person or organization, hide the true sender, or misrepresent the origin of a fax;
• interfere with the app, networks, providers, or other users.

Sensitive and regulated workflows

The app may support sensitive document workflows when you decide it is appropriate for your use. Do not rely on the app as your only channel for emergency communications, life-safety communications, or legally time-sensitive filings. For regulated or deadline-sensitive matters, verify receipt through the recipient's required process and keep independent records.

Fax Prime: Send & Receive is built with privacy and security safeguards informed by HIPAA principles, including secure handling, limited access, and service-provider controls. HIPAA obligations depend on who uses the app and for what purpose.

If you are a covered entity or business associate and your use requires a Business Associate Agreement, you must have a separate written agreement with Notera Labs Limited before using the app for workflows involving protected health information.

Purchases and subscriptions

Paid features, credits, trials, and subscriptions may be offered through Apple in-app purchase. Apple handles payment processing, renewal, billing, cancellation tools, and eligible refund requests under Apple account and App Store rules.

Subscriptions renew automatically unless canceled before renewal through your Apple account settings. Deleting the app does not cancel a subscription. Pricing, included features, quotas, and availability may change as shown in the app before purchase.

Content and permissions

You keep ownership of documents and content you submit. You grant Notera Labs Limited and its service providers the limited permission needed to process, store, transmit, receive, troubleshoot, secure, and support your fax activity.

You represent that you have all rights and permissions needed for the content you send, including any personal, confidential, copyrighted, medical, financial, or regulated information contained in it.

Service changes and suspension

We may update, limit, suspend, or discontinue parts of the app or service. We may suspend or terminate access if we believe your use violates these Terms, creates legal risk, harms recipients or providers, threatens service security, or exceeds fair and reasonable use.

No warranties

The app and service are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, error- free operation, and guaranteed fax delivery or receipt.

Limitation of liability

To the maximum extent permitted by law, Notera Labs Limited will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost documents, missed deadlines, recipient disputes, failed transmissions, or unlawful use by you or another user.

Where liability cannot be excluded, our total liability will be limited to the greater of the amount you paid for the app service in the three months before the event giving rise to the claim or USD 50.

Your responsibility for claims

If your content, recipients, fax activity, violation of these Terms, or violation of law or third-party rights causes a third-party claim, regulatory issue, loss, cost, or expense, you are responsible for it to the extent permitted by law.

Disputes

Before filing a formal claim, you agree to contact us and give both sides a reasonable opportunity to resolve the issue informally. To the extent permitted by law, disputes must be brought individually and not as a class, collective, consolidated, or representative action.

Some jurisdictions do not allow certain limitations, so parts of these Terms may not apply to you. Nothing in these Terms limits rights that cannot be waived under applicable law.

Changes

We may update these Terms from time to time. The updated version will be effective when posted unless a different date is stated. Continued use of the app after an update means you accept the updated Terms.
